Terms & Disclaimer

1. Acceptance of Terms

By accessing or using the Hurry Up Produce platform, you agree to be bound by these Terms & Disclaimer. If you do not agree, please discontinue use of the platform.

2. Platform Role

Hurry Up Produce is a connection platform only. We do not take ownership, possession, or responsibility for donated items at any point in the donation process.

3. User Responsibility

Donors and takers are solely responsible for complying with all applicable food safety laws, handling requirements, and local regulations.

4. Limitation of Liability

All transactions — including quality, safety, and transportation — are arranged directly between the donor and taker. Hurry Up Produce assumes no liability for the condition or safety of donated produce.

5. No Warranty

Produce listings are provided "as is" without warranties of any kind, whether express or implied, regarding quality, freshness, or fitness for consumption.

6. Assumption of Risk

Food quality cannot be guaranteed and takers assume the risks of all donations.

7. Indemnification

By using this platform, you agree to indemnify and hold Hurry Up Produce harmless from any claims, damages, or losses arising from your use of the service.

8. Donor (Giver) Terms — Version 3

By posting a listing you confirm the food is safe and accurately described, you agree that your listing — including your phone number, email, and pickup address — is shared with takers who accept the Taker Terms, and you accept these Terms & Disclaimer. Your acceptance is recorded with your listing (listing number, time, and IP address). When your listing goes live we send a confirmation containing your listing number to the phone number and email address you entered on the form; these are service messages about your own listing, not marketing. Message and data rates may apply.

Optional donor listing: if you tick the separate “list my organization” checkbox when posting, we publish your organization name only on our public donor list at the donor list on our Donors page. Your contact person, phone number, email address, and pickup address are never published there. This is optional and is never required to post a listing. To be removed from the donor list at any time, email hurryupproduce@outlook.com.

9. Taker Terms — Version 3

Before viewing a donor's contact information you must accept these terms: you will use the contact details only to arrange pickup of the listed produce; all arrangements, transport, and food-safety judgments are strictly between you and the donor; Hurry Up Produce does not verify donors, takers, or produce. When you accept, we record your IP address, the time, the listing number, and the terms version. These records exist so that disputes can be traced to a specific listing and acceptance.

Optional new-listing alerts: if you tick the separate alerts checkbox and give us your mobile number and email address, you consent to receive recurring text messages and emails from Hurry Up Produce about new listings in the ZIP area of the listing you were viewing. Each alert contains the listing number and the listing details only — never a donor’s contact information, which stays behind this acceptance gate on each listing page. Message frequency depends on how many donors post in that area. Message and data rates may apply. You can stop at any time by replying STOP to a text or using the unsubscribe link in any alert email. Consent to alerts is optional and is never required to view a donor’s contact information. We use your phone number and email address only to send these alerts and to identify your acceptance records — we do not sell or rent them.

10. Changes to These Terms

We may update these Terms & Disclaimer at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.

11. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions.
